An experienced transactional lawyer, Amanda focuses her practice on licensing and technology; intellectual property; and privacy and data security. She represents a broad range of media, marketing, and e-commerce clients, including media conglomerates and digital publishers; advertising and marketing agencies; video game and software developers; and authors, filmmakers, and creative entrepreneurs, in connection with a variety of transactional matters.
Amanda has extensive experience drafting and negotiating a variety of commercial agreements such as software/technology licensing and development agreements (including SaaS, PaaS, IaaS), consultant and vendor agreements, MSAs, SOWs, and NDAs. She also drafts consumer-facing agreements such as privacy policies, terms of service, and EULAs.
Amanda counsels clients on all aspects of conducting business online, including the use of cloud computing and artificial intelligence, privacy considerations, and data management.
She negotiates agreements on behalf of media companies in connection with digital advertising and integrated marketing campaigns, and negotiates sponsored content agreements on behalf of talent, agencies, and brands. Amanda regularly advises clients on matters such as sweepstakes and contest rules and regulations; native advertising and sponsored content; and FTC compliance.
Amanda represents clients in film, television, and book deals, as well as video game and mobile app development and publishing deals. She also counsels clients with respect to content clearance and fair use in connection with their creative projects.
Amanda prosecutes and enforces trademarks, and advises trademark owners on brand protection and exploitation, and merchandising and licensing opportunities.
Prior to joining MBBP, Amanda practiced in the Intellectual Property group of an international firm, and at a well-known boutique entertainment law firm. She serves as an Adjunct Professor of Trademark Law at Suffolk University Law School, has been a Guest Lecturer at Northeastern University School of Law and at the University of New Hampshire School of Law, and is a frequent speaker on social media, intellectual property, and data privacy at conferences around the country.
