  • Successfully opposed a motion for preliminary injunction to enforce a non-compete agreement against three sales executive clients based on the material change doctrine. Akibia, Inc. v. Jeffrey Hood, Ryan Gavigan and Charles Krueger (Mass. Super. Ct. 10/9/2012).
  • Obtained successful jury verdict for a Boston-area venture capital management firm in a trial at Middlesex Superior Court. The case involved an ex-managing partner who was hired by MBBP’s client to assist in the fundraising of a new venture capital fund. Soon after starting full-time, the fund terminated the executive’s employment relationship for cause. Thereafter, the employee sued for stock ownership of the fund's investment. After a 5-day trial, the jury returned verdicts in favor of the client on the “stock ownership” claim and affirmed that the employee’s termination was for cause.
